Hire Dent Limited Terms and Conditions (Dental Nurses)

THE DENTAL NURSE’S ATTENTION IS PARTICULARLY DRAWN TO CLAUSE 10 (LIMITATION OF LIABILITY).

1. Interpretation and Definitions

1.1 Definitions

Business Day means a day other than a Saturday, Sunday or public holiday in England when banks in London are open for business.

Business Hours means 9.00am to 6.00pm on a Business Day.

Charges means the £30 administration fee payable by the Dentist to Hire Dent Limited for introduction to dental nurse.

Commencement Date means the date the Dental Nurse is approved following onboarding.

Conditions means these terms and conditions as amended from time to time.

Contract means the agreement between Hire Dent Limited and the Dental Nurse incorporating these Conditions.

Data Protection Legislation means all applicable UK data protection laws including UK GDPR and the Data Protection Act 2018.

Dental Nurse means the individual dental nurse approved by Hire Dent Limited to assist a Dentist at the Premises.

Dentist means the practitioner renting the Dental Room from Hire Dent Limited.

Dental Room means the surgery room within the Premises.

Hire Dent Limited means Hire Dent Limited, registered in England and Wales (Company No. 16516319), trading as Hire a Dental Surgery.

Premises means the property where the Dental Room is located.

Services means access to the Premises and Dental Room for the purpose of assisting the Dentist.

2. Status of the Dental Nurse

2.1 The Dental Nurse is not an employee, worker, agent or partner of Hire Dent Limited.

2.2 The Dental Nurse may:

  • Be directly engaged or employed by the Dentist; or
  • Operate as a self-employed contractor engaged by the Dentist.

2.3 The Dentist is solely responsible for:

  • Payment of the Dental Nurse
  • PAYE, tax, NI contributions (if applicable)
  • Employment rights and obligations

2.4 Hire Dent Limited has no responsibility for payment or employment obligations relating to the Dental Nurse.

2.5 The £30 administration fee is payable by the Dentist to Hire Dent Limited for introduction of dental nurse and does not constitute payment for employment.

3. Onboarding and Compliance

3.1 Before attending the Premises, the Dental Nurse must complete Hire Dent Limited’s onboarding process, including:

  • Proof of identity
  • Right to work documentation
  • Current GDC registration (where applicable)
  • Evidence of indemnity insurance (where required)
  • DBS check (Enhanced)
  • Hepatitis B status confirmation
  • Any additional compliance documentation requested

3.2 Hire Dent Limited reserves the right to:

  • Refuse onboarding at its discretion
  • Request updated documents at any time
  • Suspend access if documentation lapses

3.3 The Dental Nurse must maintain current GDC registration (where required) free from conditions which would restrict practice in general dental practice.

4. Obligations of the Dental Nurse

The Dental Nurse shall:

4.1 Comply with all applicable laws and regulations, including:

  • GDC standards
  • CQC requirements
  • Health & Safety legislation
  • Infection prevention and control procedures
  • Equality Act 2010

4.2 Follow all Premises policies and procedures.

4.3 Only assist the Dentist with treatments for which they are trained and competent.

4.4 Maintain appropriate professional indemnity insurance where required.

4.5 Use equipment strictly in accordance with manufacturer instructions.

4.6 Not alter or interfere with equipment or facilities.

4.7 Leave the Dental Room clean and tidy after use.

4.8 Not bring unauthorised persons onto the Premises.

4.9 Maintain professional conduct at all times.

4.10 Immediately report:

  • Equipment faults
  • Incidents or accidents
  • Safeguarding concerns
  • Clinical governance issues

5. Clinical Responsibility

5.1 The Dentist retains full clinical responsibility for all treatment provided.

5.2 The Dental Nurse is responsible for their own professional conduct and regulatory compliance.

5.3 Hire Dent Limited accepts no responsibility for:

  • Clinical treatment
  • Advice provided to patients
  • Acts or omissions of the Dental Nurse
  • Supervision arrangements between Dentist and Dental Nurse

6. Access to the Premises

6.1 Access is granted as a licence only.

6.2 No tenancy or employment relationship is created.

6.3 Hire Dent Limited may:

  • Restrict or remove access at its discretion
  • Refuse entry if a Dental Nurse appears unfit for work
  • Enter the Dental Room at any time

6.4 Access is limited to assisting the Dentist during the booked Hire Period.

7. Data Protection and Confidentiality

7.1 The Dental Nurse must comply with all Data Protection Legislation.

7.2 Patient data must:

  • Only be accessed where necessary
  • Remain confidential
  • Not be removed from clinical systems without authorisation

7.3 The Dental Nurse must not use patient data for marketing or personal purposes.

7.4 Confidential business information of Hire Dent Limited must not be disclosed.

8. Insurance

8.1 The Dental Nurse must maintain:

  • Professional indemnity insurance (where applicable)
  • Personal liability cover if self-employed

8.2 Evidence of insurance must be provided upon request.

9. Indemnity

9.1 The Dental Nurse shall indemnify Hire Dent Limited against all losses arising from:

  • Breach of these Conditions
  • Negligence or misconduct
  • Regulatory breaches
  • Data protection breaches
  • Damage to equipment or Premises

10. Limitation of Liability

THE DENTAL NURSE’S ATTENTION IS PARTICULARLY DRAWN TO THIS CLAUSE.

10.1 Nothing limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation

10.2 Subject to clause 10.1, Hire Dent Limited shall not be liable for:

  • Loss of earnings
  • Loss of reputation
  • Indirect or consequential loss
  • Injury to the Dental Nurse unless caused by Hire Dent Limited’s negligence

10.3 Hire Dent Limited’s total liability shall not exceed £1,000 per incident.

11. Suspension and Termination

11.1 Hire Dent Limited may suspend or terminate access immediately if:

  • GDC registration lapses
  • Insurance lapses
  • There is regulatory investigation
  • Misconduct occurs
  • Non-compliance with onboarding
  • Criminal conviction (excluding minor traffic offences)
  • DBS concerns arise

11.2 Termination does not affect accrued rights.

12. General

12.1 These Conditions do not create a partnership or employment relationship.

12.2 Hire Dent Limited may amend these Conditions from time to time.

12.3 If any provision is invalid, the remainder remains enforceable.

12.4 English law governs this agreement.
